Liability Waiver: (For Parent/Legal Guardian/Authorized Representative of Participant(s) Under 18 Years of Age and Participants Who Are 18 or Older)

By clicking continue, I, as parent, legal guardian, authorized representative of the participating minor (hereinafter “Minor”) or as a participant who is 18 years of age or older hereby grant the permission necessary to allow Minor and/or myself to participate in the sports/performance training to be conducted by Iron Diamond Sports, LLC to be held at Wingate Park/Jacksonville Beach Baseball Association and the surrounding complex. I, on my own behalf and/or on behalf of the Minor, our heirs, representatives, executors, administrators and assigns, do hereby release, relieve, covenant not to sue and forever discharge, indemnify and hold harmless, Iron Diamond Sports, LLC, its trustees, officers, agents, employees, independent contractors, and volunteers (hereinafter collectively “Releasees”) of any and from all claims, demands, rights, liabilities, losses, expenses, and causes of action (with the exception of gross negligence or willful misconduct) of whatever kind or nature including, but not limited to, negligence, arising from and by reason of any and all known and unknown, foreseen and unforeseen bodily and personal injuries, damage to property, and the consequences thereof, including death, resulting from any participation in or in any way connected with arising out of or connected with the sports/performance training, including any claim arising out of or connected with any illness or injury (minimal, serious, catastrophic and/or death) that the Minor and/or myself may incur or sustain during the sports/performance training, all activities associated with the sports/performance training and while traveling to and from the site for the sports/performance training whether or not the sports/performance training actually occurs. I, on my own behalf and/or on behalf of the Minor, hereby warrant that I have read this Release of Liability in its entirety and fully understand its contents. I, on my own behalf and/or on behalf of the Minor, am aware that this Release and Liability releases Releasees from liability and contains an acknowledgement of my voluntary and knowing assumption of the risk of injury or illness.

Medical Release: By clicking continue, I, on my own behalf and/or on behalf of the Minor, acknowledge and agree that such participation subjects myself and/or the Minor to the possibility of physical illness or injury (minimal, serious, catastrophic and/or death) and that I, on my own behalf and/or on behalf of the Minor, acknowledge that I am and/or the Minor is in good health, physically fit and mentally capable of participating in sports/performance training activities, and I hereby give full approval for my own participation and/or the Minor’s participation in the sports/performance training. In the event of such illness or injury, I authorize Iron Diamond Sports, LLC to obtain necessary medical treatment for myself and/or of the Minor and hereby, on my own behalf and/or on behalf of the Minor, release and hold harmless Releasees in the exercises of this authority. I further acknowledge and understand that I will be responsible for any and all medical and related bills that may be incurred on my behalf and/or on behalf of the Minor for any illness or injury that I and/or the Minor may sustain during the sports/performance training and while traveling to and from the site for the sports/performance training.

By clicking continue, I, on my own behalf and/or on behalf of the Minor hereby acknowledge that I have carefully read and understood this Release of Liability and Assumption of Risk Agreement before signing/checking the boxes and agree to comply with the above terms and conditions of this Agreement. I intend this to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that, if any portion of this Agreement is held to be invalid, the remaining portions of this Agreement, notwithstanding, shall continue in full force and effect.

Further, by clicking continue, I acknowledge that I am either 18 or older, or the minor’s parent, guardian or have been authorized by the minor’s parent(s) or guardian to act on the minor’s behalf, including executing this release agreement on behalf of the minor.

• All appointments must be paid in full, when booking a lesson online. This means the only form of payment is credit card.

• Clients will be able to schedule online on a first-come, first-served basis. Clients may reserve appointments by paying for them in advance, online. Due to availability, it is highly recommended to schedule/reserve ALL appointments that are paid for in advance.

• There will be a $30.00 fee for all returned credit card transactions.

• Baseball/Softball lesson(s)/packages & Sports Performance/Personal Training packages will expire after six (6) months from date of purchase. Please keep this in mind when purchasing packages.

Notice of cancellation and/or rescheduling more than twenty-four hours prior to scheduled appointment(s) is eligible for a rescheduled appointment. NO REFUND will be offered.

Notice of cancellation and/or rescheduling within twenty-four hours of scheduled appointment(s) (including late arrival and “no-show”) is subject to pay a fee consistent with the full cost of the appointment(s).

Cancellations or rescheduling should be done through Appointments Plus, if done outside of the twenty-four hour window.  Iron Diamond Sports is not responsible for helping clients remember their scheduled appointment(s). If you need to cancel within the twenty-four hour window, please notify Iron Diamond Sports via email or text. You will not receive a refund or rescheduled appointment in this situation.
